Con licenza CC BY-SA 3.0 via Wikimedia Commons)<\/figcaption><\/figure>\n<p>Il Tribunale federale ha cos\u00ec annullato una sentenza del Tribunale superiore di Zurigo del novembre 2015 e l'ha rinviata al tribunale inferiore.<\/p>\n<p>Nel caso specifico, due persone avevano affittato un appartamento di 3,5 stanze a Zurigo nel 2013 a un canone di 3.900 franchi pi\u00f9 300 franchi per spese accessorie. Gli inquilini si sono rivolti alla commissione di conciliazione sostenendo di essere stati praticamente costretti a firmare il contratto di locazione a causa della difficile situazione del mercato immobiliare zurighese: dal loro punto di vista, esisteva una situazione di emergenza. Tale situazione si verificava se il tasso di posti vacanti era inferiore all'1,5%. Nel suo caso, era solo lo 0,11%.<\/p>\n<p>Gli inquilini hanno chiesto una riduzione dell'affitto iniziale di 1.100 franchi. Un accordo extragiudiziale \u00e8 fallito e anche il tribunale superiore ha respinto la richiesta. Non era sufficiente che un inquilino dimostrasse di essere in difficolt\u00e0 o di avere bisogno di un alloggio. Piuttosto, doveva dimostrare di essere in difficolt\u00e0 per questo motivo e che non c'erano alternative, si disse all'epoca.<\/p>\n<p><strong>Squilibrio tra proprietario e inquilino<\/strong><\/p>\n<p>Nella sua sentenza, la Corte Suprema Federale ha ritenuto che la legge prevedesse tre motivi alternativi per contestare un canone di locazione iniziale, ovvero un aumento significativo dell'affitto rispetto all'inquilino precedente, il disagio personale e le condizioni precarie del mercato immobiliare locale. Gli ultimi due motivi non devono essere soddisfatti cumulativamente, come richiesto dalla Corte Suprema di Zurigo, ha sentenziato il Tribunale federale. La carenza di alloggi non pu\u00f2 essere dimostrata solo con le statistiche attuali. Un inquilino pu\u00f2 dimostrare una carenza di alloggi anche provando una ricerca intensiva ma infruttuosa (sentenza del 18.5.2016, 4 A_691\/2015).<\/p>\n<p>La Corte Suprema Federale ha espresso l'opinione che una carenza di alloggi giustifichi la contestazione di un canone di locazione iniziale al fine di contrastare eventuali abusi in caso di squilibrio del mercato. \u00c8 un \"fatto assodato che i consumatori in generale e i locatari in particolare non occupano una posizione paragonabile a quella dei fornitori che potrebbe consentire loro di negoziare un contratto equilibrato\", ha affermato la Corte suprema. Il principio del rispetto dei contratti si applica senza limitazioni. Ma solo se controparti uguali e di pari forza stipulano un contratto, scrivono i giudici di Losanna nella loro decisione.<\/p>\n<p>L'Associazione degli inquilini di Zurigo accoglie con favore la sentenza, ma l'Associazione svizzera dei proprietari di case \u00e8 indignata. Se ogni inquilino pu\u00f2 contestare il canone di locazione dopo aver firmato il contratto, il principio di buona fede viene minato.<\/p>","protected":false},"excerpt":{"rendered":"<p>Una sentenza recentemente pubblicata dal Tribunale federale sull'importo del canone di locazione iniziale ha suscitato grande scalpore.
