Ora \u00e8 disponibile. In una sentenza di primo grado del 2 agosto 2021, il tribunale delle locazioni di Zurigo ha dato ragione al locatore che aveva fatto causa per il pagamento dell'intero affitto di uno spazio commerciale per la durata dei periodi di chiusura ufficialmente imposti. Anche se alcuni avvocati sostengono l'opinione opposta, il tribunale \u00e8 arrivato alla conclusione che di regola la qualit\u00e0 concordata dell'oggetto in affitto riguarda solo le propriet\u00e0 relative all'oggetto e non anche quelle relative al funzionamento, riferisce SVIT. Cos\u00ec, le specifiche ufficiali da sole, come sono state date durante il periodo pandemico, non hanno costituito un difetto dell'oggetto del noleggio.<\/p>\n<p>Tuttavia, la corte ha sottolineato che il passaggio tra un disturbo di equivalenza \"ancora nei limiti\" e uno \"grave\", che giustificherebbe un'eventuale richiesta di riduzione dell'affitto, pu\u00f2 essere determinato solo in base alla valutazione di tutte le circostanze del caso individuale specifico. Questo significava, tra l'altro, che il padrone di casa poteva esigere di vedere le cifre d'affari dall'inquilino per valutare un eventuale reclamo.
