De nouvelles \u00e9tudes ont d\u00e9montr\u00e9 que le secteur immobilier suisse se r\u00e9v\u00e8le \u00e9galement attractif pour le blanchiment d'argent. Outre la grande stabilit\u00e9 du pays et sa grande attractivit\u00e9 en tant que lieu de r\u00e9sidence et de vacances, des lacunes consid\u00e9rables dans le dispositif de lutte contre le blanchiment d'argent y contribueraient notamment.<\/p>\n<p>\"Aujourd'hui, il est relativement facile d'acqu\u00e9rir un bien immobilier suisse avec des fonds ill\u00e9gaux sans \u00eatre d\u00e9couvert. Cela ne doit plus \u00eatre possible. De telles op\u00e9rations criminelles nuisent au march\u00e9 immobilier suisse et \u00e0 l'ensemble de l'\u00e9conomie. En outre, elles sapent l'\u00e9tat de droit et le d\u00e9veloppement \u00e9conomique des pays d'origine des fonds ill\u00e9gaux\", d\u00e9clare Martin Hilti, directeur de TI Suisse.<\/p>\n<p>TI critique d'une part le fait que le champ d'application de la loi actuelle sur le blanchiment d'argent ne s'\u00e9tend g\u00e9n\u00e9ralement pas aux acteurs centraux d'une transaction immobili\u00e8re - comme les notaires et les agents immobiliers - mais se limite en grande partie aux interm\u00e9diaires financiers. Or, dans la plupart des cas, ces derniers ne seraient pas suffisamment impliqu\u00e9s dans une transaction immobili\u00e8re pour pouvoir effectivement identifier et d\u00e9clarer le blanchiment d'argent. TI demande donc que le champ d'application de la loi sur le blanchiment d'argent soit adapt\u00e9 aux normes internationales en vigueur dans le secteur immobilier : Il devrait \u00e9galement inclure d'autres activit\u00e9s de notaires, d'agents immobiliers, d'avocats et d'autres professions juridiques ind\u00e9pendantes ainsi que de comptables.<\/p>\n<p><strong>Insuffisance de la Lex Koller, manque de transparence du registre foncier<\/strong><\/p>\n<p>La Lex Koller est \u00e9galement insuffisante en mati\u00e8re de pr\u00e9vention du blanchiment d'argent, car la loi actuelle n'offre pas suffisamment d'instruments permettant de d\u00e9tecter et de sanctionner le blanchiment d'argent. Or, les plus grands risques de blanchiment d'argent dans le secteur immobilier suisse existent lors de l'acquisition de biens immobiliers par des personnes \u00e9trang\u00e8res et tout particuli\u00e8rement par des soci\u00e9t\u00e9s de domicile \u00e9trang\u00e8res. Dans le cadre de la r\u00e9vision actuelle de la Lex Koller, des mesures cibl\u00e9es visant \u00e0 emp\u00eacher le blanchiment d'argent lors de l'acquisition de biens immobiliers devraient donc \u00eatre int\u00e9gr\u00e9es, demande TI.<\/p>\n<p>En outre, TI estime que les particularit\u00e9s du registre foncier suisse, notamment son caract\u00e8re incomplet et la lourdeur du syst\u00e8me de consultation du registre foncier, contribuent \u00e0 ce que les cas de blanchiment d'argent soient tr\u00e8s difficiles, voire impossibles \u00e0 d\u00e9tecter. L'organisation demande donc d'am\u00e9liorer la qualit\u00e9 et la transparence des informations du registre foncier suisse.<\/p>\n<p>TI Suisse est la section suisse de Transparency International, la principale organisation non gouvernementale mondiale de lutte contre la corruption.
