Pour y parvenir, le r\u00e8glement de construction de la ville de Berne doit \u00eatre modifi\u00e9.<\/p>\n<p>L'association des propri\u00e9taires fonciers de Berne et des environs ainsi que plusieurs particuliers ont d\u00e9pos\u00e9 un recours contre cette d\u00e9cision aupr\u00e8s de la JCE. Leur argumentation : les nouvelles prescriptions porteraient atteinte au droit des propri\u00e9taires d'utiliser leurs terrains comme ils l'entendent.<\/p>\n<p>La JCE ne voit cependant pas dans les nouvelles r\u00e8gles de construction de la ville de Berne une violation de la garantie de la propri\u00e9t\u00e9 ancr\u00e9e dans la Constitution f\u00e9d\u00e9rale. Le r\u00e8glement de construction de la ville de Berne constitue une base l\u00e9gale suffisante pour l'intervention et celle-ci n'est pas non plus jug\u00e9e \"grave\" au sens de la jurisprudence du Tribunal f\u00e9d\u00e9ral, indique la JCE dans un communiqu\u00e9. Les restrictions sont proportionn\u00e9es, car elles laissent aux propri\u00e9taires suffisamment de possibilit\u00e9s d'utiliser leur propri\u00e9t\u00e9 de mani\u00e8re rentable, m\u00eame avec l'obligation de mettre \u00e0 disposition des logements \u00e0 prix mod\u00e9r\u00e9s, estime le tribunal.<\/p>\n<p>La d\u00e9cision du JGK peut encore faire l'objet d'un recours devant le tribunal administratif.<\/p>","protected":false},"excerpt":{"rendered":"<p>La Direction de la justice, des affaires communales et des affaires eccl\u00e9siastiques du canton de Berne (JCE) a rejet\u00e9 le recours contre la mise en \u0153uvre de l'initiative sur le logement dans la ville de Berne.
