Ce qui n'est pas aussi s\u00fbr, c'est ce que l'on peut apprendre exactement du cas Signa - et pour qui. Pour de nombreux acteurs, le monde de l'illustre Monsieur Benko semble bien \u00e9loign\u00e9 de leur propre r\u00e9alit\u00e9. Lors du r\u00e9cent d\u00e9bat sur l'immobilier au \"Metropol\" de Zurich, la question inqui\u00e9tante de savoir si nous ne sommes pas tous un peu Benko a \u00e9t\u00e9 soulev\u00e9e \u00e0 plusieurs reprises. Ce qui s'est av\u00e9r\u00e9 en tout cas, c'est que l'on serait bien avis\u00e9 de mettre r\u00e9guli\u00e8rement \u00e0 l'\u00e9preuve les certitudes apparentes.<\/p>\n<h3>Il n'y a pas une seule cause<\/h3>\n<p>Georg J. Wohl \u00e9tait un intervenant qui a particuli\u00e8rement retenu l'attention de l'assembl\u00e9e. On pr\u00eate en effet \u00e0 cet associ\u00e9 de Staiger Rechtsanw\u00e4lte AG une expertise particuli\u00e8re dans l'affaire Signa. Dans le cadre d'une proc\u00e9dure en Suisse, o\u00f9 il est \u00e9galement question de biens immobiliers de d\u00e9tail de l'entreprise en faillite, il repr\u00e9sente les int\u00e9r\u00eats d'un cr\u00e9ancier. Il va de soi qu'il n'a pas \u00e9t\u00e9 autoris\u00e9 \u00e0 parler en d\u00e9tail, mais lorsque le pr\u00e9sentateur Markus Schmidinger lui a demand\u00e9 ce qui l'avait le plus surpris dans le cadre de Signa, le juriste n'a pas h\u00e9sit\u00e9 \u00e0 r\u00e9pondre. Ce sont les valeurs des biens immobiliers, a-t-il dit. Ou plus pr\u00e9cis\u00e9ment l'\u00e9volution de ces valeurs en peu de temps. On s'\u00e9tait apparemment berc\u00e9 de pr\u00e9tendues certitudes, par exemple en ce qui concerne le comportement d'achat des personnes tr\u00e8s riches. On pensait que le porte-monnaie d'une certaine client\u00e8le resterait l\u00e9ger m\u00eame si d'autres devaient se serrer la ceinture, et on pensait que certains emplacements avec certains locataires de d\u00e9tail \u00e9taient \u00e0 l'abri des mauvaises surprises. Ce n'est jamais une seule cause qui se r\u00e9v\u00e8le \u00eatre l'erreur apr\u00e8s coup, a d\u00e9clar\u00e9 Wohl. Il y a toujours plusieurs \u00e9v\u00e9nements qui se conjuguent et, \u00e0 un moment donn\u00e9, la fameuse goutte d'eau qui fait d\u00e9border le vase.<\/p>\n<h3>Known Unknowns<\/h3>\n<p>Ceux qui ne veulent pas prendre de risques ne devraient pas d\u00e9velopper de projets immobiliers. Les d\u00e9veloppeurs de projets ne peuvent pas faire autrement que de prendre des risques, comme l'a tr\u00e8s bien fait remarquer Schmidinger. Marco Tondel, responsable du d\u00e9veloppement et Chief Sustainability Officer chez Mobimo Management AG, a utilis\u00e9 une belle image pour d\u00e9crire le monde du d\u00e9veloppement de projets : il a compar\u00e9 cette activit\u00e9 \u00e0 un man\u00e8ge et \u00e0 des montagnes russes. Celui qui d\u00e9veloppe un bien immobilier s'expose in\u00e9vitablement \u00e0 des forces centrifuges. Il a toutefois le choix de s'engager dans un jeu de carrousel tournant tranquillement avec des si\u00e8ges fixes ou dans un man\u00e8ge \u00e0 cha\u00eenes un peu plus dynamique - voire dans des montagnes russes. La rotation autour d'un axe sur un man\u00e8ge a l'avantage d'\u00eatre calculable, ce qui signifie toutefois aussi que le plaisir - c'est-\u00e0-dire le rendement - est limit\u00e9. Sur les montagnes russes, en revanche, la direction des forces qui vous tirent est impr\u00e9visible. Si les risques commencent \u00e0 sortir du cadre des comp\u00e9tences propres, a averti Tondel, les montagnes russes deviennent rapidement un train fant\u00f4me.<\/p>\n<p>Le d\u00e9veloppeur n'a pas la fameuse boule de cristal, mais il peut se baser sur ce qu'il sait. Et cela signifie aussi - pour paraphraser Donald Rumsfeld - s'orienter sur tout ce que l'on ne peut pas pr\u00e9voir. Tondel a \u00e9num\u00e9r\u00e9 : la politique, les nombreuses oppositions, la dur\u00e9e des proc\u00e9dures et les prix de la construction. Le Senior Portfolio Manager Real Estate chez Helvetia a surtout parl\u00e9 des risques qui se laissent mal ou pas du tout diversifier. Cela ne signifie pas pour autant qu'en tant qu'acteur immobilier, on est impuissant dans de tels cas. En ce qui concerne le financement, Tedeschi a par exemple expliqu\u00e9 qu'il valait la peine de comparer les banques : non seulement les offres sont d\u00e9sormais disparates, mais un m\u00eame \u00e9tablissement peut proposer des conditions tr\u00e8s diff\u00e9rentes au fil du temps. En ce qui concerne le risque d'\u00e9valuation, qui devient de plus en plus virulent, le gestionnaire de fonds a notamment conseill\u00e9 d'\u00e9laborer suffisamment t\u00f4t un plan B pour d'\u00e9ventuelles ventes et de se poser la question suivante : quels sont les biens immobiliers qui rencontrent actuellement une demande sur le march\u00e9 ? En mati\u00e8re d'ESG, l'un de ses conseils \u00e9tait de renoncer au greenwashing, de maintenir des normes \u00e9lev\u00e9es et de miser sur la transparence. La soir\u00e9e a \u00e9galement apport\u00e9 une autre bonne nouvelle : m\u00eame lorsque l'enfant est tomb\u00e9 dans le puits, il est encore possible de sauver certaines choses. C'est ainsi que l'on pouvait comprendre l'expos\u00e9 de Wohl, qui a soulign\u00e9 de mani\u00e8re impressionnante les chances du mod\u00e8le de sursis concordataire - le \"Chapter 11\" suisse, qui existe d\u00e9j\u00e0 depuis dix ans. Avec 150 cas d'application au maximum sur 15 000 proc\u00e9dures de faillite par an, cette proc\u00e9dure d'assainissement vit encore dans l'ombre - mais elle gagne en importance. Et pour de bonnes raisons, selon Wohl. Le sursis concordataire permet une r\u00e9alisation \"douce et efficace\" pour les garants. En ce qui concerne les biens immobiliers, il offre de grands avantages : Le mod\u00e8le permet dans de nombreux cas une vente rapide des biens immobiliers et, en raison de la s\u00e9curit\u00e9 juridique, des prix plus \u00e9lev\u00e9s.
