Mais chaque ann\u00e9e, la population augmente d'environ un pour cent. Actuellement, selon l'Office f\u00e9d\u00e9ral de la statistique, la population r\u00e9sidante permanente de la Suisse compte environ 8,8 millions de personnes. Environ 1,5 million de personnes vivent dans le canton de Zurich. Afin de pouvoir profiter de la croissance d\u00e9mographique et \u00e9conomique tout en continuant \u00e0 d\u00e9velopper la qualit\u00e9 de vie et d'implantation du canton de Zurich, des r\u00e9glementations sont introduites. La protection des sites, du bruit et des locataires doit garantir une cohabitation mod\u00e9r\u00e9e, tout comme le gel des mises en zone, les taxes sur les plus-values et les d\u00e9classements.<\/p>\n<p>Mais la r\u00e9glementation cumul\u00e9e provoque-t-elle une p\u00e9nurie de logements ? Et o\u00f9 pourrait-on ou devrait-on assouplir et o\u00f9 devrait-on am\u00e9liorer ? Trois experts ont discut\u00e9 de ces questions lors du 90e d\u00e9bat sur l'immobilier \u00e0 Zurich et ont pr\u00e9sent\u00e9 leurs exp\u00e9riences et leurs \u00e9bauches de solutions. Christian Kraft, de la Haute \u00e9cole de Lucerne, a anim\u00e9 la soir\u00e9e qui s'est d\u00e9roul\u00e9e au \"Metropol\" de Zurich et \u00e0 laquelle ont particip\u00e9 une centaine de personnes.<\/p>\n<p><strong>Autorisations \u00e0 un niveau bas<\/strong><br \/>\n\"La croissance de la population est actuellement \u00e9norme\", a-t-il introduit les auditeurs en illustrant son propos par les chiffres de la strat\u00e9gie de d\u00e9veloppement territorial \u00e0 long terme du canton de Zurich, datant de 2014 : selon cette strat\u00e9gie, le canton s'attendait \u00e0 accueillir 280 000 personnes suppl\u00e9mentaires d'ici 2040, dont 80 pour cent vivraient dans l'espace urbain. 140 000 personnes ont d\u00e9j\u00e0 immigr\u00e9. \"Ainsi, 50 pour cent des pr\u00e9visions se sont d\u00e9j\u00e0 r\u00e9alis\u00e9es\", a d\u00e9clar\u00e9 Kraft.<\/p>\n<p>Les personnes suppl\u00e9mentaires ont bien s\u00fbr besoin d'espace pour se loger. Toutefois, selon Kraft, le temps moyen n\u00e9cessaire pour obtenir l'autorisation de construire de nouveaux logements ne cesse d'augmenter. \"Le nombre de logements locatifs autoris\u00e9s \u00e0 la construction est actuellement \u00e0 son niveau le plus bas de ces dix derni\u00e8res ann\u00e9es\", a poursuivi Kraft. Le terme de p\u00e9nurie de logements ne s'applique pas actuellement en raison de la qualit\u00e9 des logements. Il attribue la p\u00e9nurie de logements \u00e0 la baisse et \u00e0 la stagnation actuelle du nombre de demandes de permis de construire. \"En raison de la hausse des taux d'int\u00e9r\u00eat et du financement, de nombreux ma\u00eetres d'ouvrage ont report\u00e9 ou annul\u00e9 leur projet de construction\", a d\u00e9clar\u00e9 Weinert. Mais le nombre de permis de construire est \u00e9galement en forte baisse. Ceux-ci n'ont pratiquement pas \u00e9t\u00e9 accord\u00e9s en raison de nombreux recours et pour des raisons juridiques, a-t-il ajout\u00e9. Alors que l'offre de logements diminue, la demande, elle, continue d'augmenter. Cette tendance est renforc\u00e9e par le fait que de plus en plus de personnes \u00e2g\u00e9es vivent plus longtemps dans leur logement et que les jeunes vivent \u00e9galement plus souvent dans des m\u00e9nages d'une ou deux personnes.<\/p>\n<p>M\u00eame si l'offre saisonni\u00e8re de logements est \u00e0 nouveau plus importante, l'offre de logements \u00e0 louer est, selon Weinert, en constante diminution. Pour le locataire, cela a pour cons\u00e9quence qu'en cas de p\u00e9nurie de logements, les loyers propos\u00e9s augmentent fortement. En 2023, ils augmenteront d\u00e9j\u00e0 d'environ trois pour cent. \"Les loyers existants vont \u00e9galement augmenter\", pr\u00e9voit Weinert.<\/p>\n<p>Weinert a donn\u00e9 les raisons de la p\u00e9nurie de logements en prenant l'exemple des Grisons, o\u00f9 il est particuli\u00e8rement difficile de trouver un logement. Cela serait li\u00e9 \u00e0 la taxe sur les r\u00e9sidences secondaires, qui a des r\u00e9percussions sur la construction de logements locatifs. \"On construit moins de logements locatifs dans les communes\", explique Weinert. Cette situation a des r\u00e9percussions sur les loyers et donc sur la charge des frais de logement, qui ne cesse d'augmenter et qui s'\u00e9l\u00e8ve actuellement \u00e0 28% du revenu.<br \/>\nLa situation est diff\u00e9rente pour les logements en propri\u00e9t\u00e9. \"La situation semble se d\u00e9tendre\", explique Weinert. Cela s'explique par le fait qu'il y a plus de biens sur le march\u00e9 et qu'il faut plus de temps pour trouver un acheteur potentiel.<\/p>\n<p>Le mod\u00e9rateur Christian Kraft a finalement r\u00e9sum\u00e9 : \"Comme la croissance de la demande est plus forte que la croissance de la population, alors que le niveau de planification est bas, la pression sur les villes augmente donc. Mais comment faire de la place dans les villes\" ? C'est la question que Kraft a pos\u00e9e \u00e0 l'orateur suivant, Nicola Haas, membre de la direction de Refolio Real Estate, une entreprise de conseil ax\u00e9e sur l'architecture, le d\u00e9veloppement de projets et la gestion de portefeuilles.<\/p>\n<p>Dans son expos\u00e9, Nicola Haas s'est focalis\u00e9 sur la compensation des plus-values sur les plus-values de planification et a remis en question la soi-disant \"taxe de construction\" pour la densification. Mais qu'est-ce que la compensation de la plus-value au juste ? \"Il s'agit d'une taxe pr\u00e9lev\u00e9e par l'Etat sur la plus-value d'un terrain r\u00e9sultant d'une mesure d'am\u00e9nagement, comme par exemple une r\u00e9vision du r\u00e8glement d'urbanisme (BZO) pr\u00e9voyant un classement en zone \u00e0 b\u00e2tir, un d\u00e9classement ou un changement d'affectation.<\/p>\n<p>Les communes peuvent fixer le taux de la taxe sur la plus-value entre 20 et 40 pour cent. La compensation de la plus-value est ensuite per\u00e7ue dans le cadre d'une proc\u00e9dure en deux \u00e9tapes. Apr\u00e8s l'entr\u00e9e en vigueur de la r\u00e9vision du BZO, une d\u00e9cision de fixation individuelle est d'abord adress\u00e9e aux propri\u00e9taires fonciers. La compensation de la plus-value est ainsi fix\u00e9e. \"Si l'autorisation de construire est accord\u00e9e et que le terrain est construit, la d\u00e9cision d'octroi intervient dans un deuxi\u00e8me temps, dans un d\u00e9lai de 30 jours\", explique Haas. La seule exception concerne les mesures de construction mineures, comme les r\u00e9novations ou les extensions d'un b\u00e2timent existant de moins de 100 m\u00e8tres carr\u00e9s de surface de plancher imputable. Il a soulign\u00e9 : \"Il n'y a que des tendances sur la direction \u00e0 prendre. Je ne peux donc pas proclamer de v\u00e9rit\u00e9s absolues\". L'effet de la loi ne sera visible que dans les ann\u00e9es \u00e0 venir.<\/p>\n<p>Haas est toutefois d'avis que la compensation de la plus-value, au lieu de favoriser la densification, a plut\u00f4t l'effet inverse. Ainsi, il faut g\u00e9n\u00e9ralement disposer de liquidit\u00e9s importantes pour un projet de construction afin de pouvoir le mener \u00e0 bien. \"La compensation de la plus-value ne facilite pas le financement\", dit-il. Au contraire : \"La compensation de la plus-value impose les gains en capital non r\u00e9alis\u00e9s et comment payer un gain en capital qui n'apporte pas de liquidit\u00e9s\", explique Haas. Pour certains propri\u00e9taires, cela rend m\u00eame la r\u00e9alisation d'un projet plus difficile, voire l'exclut.<\/p>\n<p>Selon Haas, la compensation de la plus-value a tendance \u00e0 s'opposer \u00e0 la densification interne, car elle rend dans certains cas plus difficile le financement de projets de construction avec extension de la surface, alors que la compensation de la plus-value ne touche pas les projets de construction sans extension de la surface. De plus, la compensation de la plus-value rendrait la consommation des r\u00e9serves d'utilisation moins attrayante que les investissements alternatifs.<\/p>\n<p><strong>Du point de vue d'une ville<\/strong><br \/>\nEnfin, Barbara Thalmann, maire d'Uster, a abord\u00e9 le sujet sous un autre angle. Du point de vue de la ville, elle doit quotidiennement trouver des solutions avec les propri\u00e9taires, les entreprises de construction ainsi que la population. \"Actuellement, Uster compte 36 000 habitants. Mais la ville doit s'orienter vers une croissance de 20 \u00e0 25 pour cent\", a-t-elle d\u00e9clar\u00e9. C'est un d\u00e9fi, mais la ville s'est engag\u00e9e dans la voie de la pr\u00e9paration et de la r\u00e9alisation de cet objectif, a-t-elle ajout\u00e9.<\/p>\n<p>\"Pour ce faire, nous avons initi\u00e9 un concept de d\u00e9veloppement urbain et pos\u00e9 la question de savoir comment la ville doit se d\u00e9velopper sous le p\u00e9rim\u00e8tre de densification\", a d\u00e9clar\u00e9 la pr\u00e9sidente de la ville. Selon elle, ce ne sont pas seulement les questions de construction qui sont pertinentes, mais aussi la mobilit\u00e9 et la mani\u00e8re de pr\u00e9server la qualit\u00e9, les espaces verts et l'histoire de la ville.<\/p>\n<p>Les habitants d'Uster doivent pouvoir continuer \u00e0 vivre et \u00e0 travailler \u00e0 l'avenir. Pour cela, des r\u00e9glementations et des lois sont n\u00e9cessaires, que la ville peut d\u00e9finir au moyen du r\u00e8glement de construction et de zone (BZO) et des plans d'am\u00e9nagement.<\/p>\n<p>La compensation de la plus-value a \u00e9galement \u00e9t\u00e9 discut\u00e9e \u00e0 Uster et a finalement \u00e9t\u00e9 fix\u00e9e \u00e0 30 pour cent. \"Tout d'abord, nous avons re\u00e7u un plan d'am\u00e9nagement d'un ma\u00eetre d'ouvrage priv\u00e9 pour un site industriel, qui a \u00e9t\u00e9 r\u00e9alis\u00e9 et mis en \u0153uvre conform\u00e9ment \u00e0 la loi sur la taxe sur la plus-value\", a d\u00e9clar\u00e9 Thalmann. On s'est mis d'accord avec le ma\u00eetre d'ouvrage pour qu'il ne paie pas. Au lieu de cela, il s'engage \u00e0 cr\u00e9er des emplois ou des logements d'utilit\u00e9 publique.<\/p>\n<p>Thalmann estime qu'il serait plus judicieux d'indemniser la plus-value par une plus-value pour le site lui-m\u00eame plut\u00f4t que par de l'argent. Comme par exemple l'am\u00e9nagement d'espaces verts.
