Ce contrat-type doit \u00eatre utilis\u00e9 \u00e0 l'avenir lorsque les CFF c\u00e8dent des terrains en droit de superficie \u00e0 des ma\u00eetres d'ouvrage d'utilit\u00e9 publique. Ainsi, les contrats de droit de superficie ne devront plus \u00eatre ren\u00e9goci\u00e9s pour chaque projet.<\/p>\n<p>Le calcul et l'\u00e9volution de la rente du droit de superficie sont notamment r\u00e9glement\u00e9s. Elle est bas\u00e9e sur le loyer bas\u00e9 sur les co\u00fbts et correspond aux lignes de co\u00fbts de l'OFL. Les CFF, l'OFL et Coop\u00e9ratives d'habitation Suisse \u00e9crivent dans un communiqu\u00e9 commun qu'il est ainsi garanti que les logements d'utilit\u00e9 publique au sens de la loi sur le logement (LOG) restent avantageux \u00e0 long terme.<\/p>\n<p>Le nouveau contrat-type tient \u00e9galement compte du fait que les CFF, en tant que propri\u00e9taires des terrains, participent mod\u00e9r\u00e9ment \u00e0 l'augmentation de la valeur des aires, comme l'exigent les objectifs strat\u00e9giques de la Conf\u00e9d\u00e9ration. Les CFF doivent d\u00e9velopper leurs terrains ferroviaires de mani\u00e8re cibl\u00e9e et contribuer ainsi \u00e0 long terme \u00e0 un syst\u00e8me ferroviaire financi\u00e8rement sain.<\/p>\n<p>Comme l'explique Alexander Muhm, responsable de CFF Immobilier, les CFF visent \u00e0 proposer environ la moiti\u00e9 de leurs logements \u00e0 des prix avantageux, soit par le biais de logements propres, soit par la mise \u00e0 disposition en droit de superficie. Le nouveau contrat est un pas important dans cette direction.<\/p>\n<p>Eva Herzog, pr\u00e9sidente de Coop\u00e9ratives d'habitation Suisse, d\u00e9clare que les rentes de droit de superficie pour la construction de logements d'utilit\u00e9 publique se situeront \u00e0 la limite sup\u00e9rieure en termes de prix.
