Un plafond de loyer de 20.000 CHF sera appliqu\u00e9. Les \u00e9tablissements qui ont d\u00fb r\u00e9duire leurs activit\u00e9s doivent b\u00e9n\u00e9ficier d'une r\u00e9duction limit\u00e9e. Pour les loyers compris entre 15.000 et 20.000 CHF, le locataire et le bailleur peuvent renoncer \u00e0 cette solution et les accords d\u00e9j\u00e0 conclus doivent rester valables. Pour les bailleurs, le Conseil f\u00e9d\u00e9ral doit pr\u00e9voir un fonds pour les cas de rigueur de 20 millions.<\/p>\n<p>Lundi prochain (8 juin), le Conseil des Etats se penchera sur une motion de m\u00eame teneur. S'il l'adopte, l'intervention sera consid\u00e9r\u00e9e comme transmise.<\/p>\n<p>Lors de la session extraordinaire de Corona d\u00e9but mai, les Chambres n'avaient pas r\u00e9ussi \u00e0 se mettre d'accord sur une solution pour les entreprises artisanales. Le Conseil des Etats avait fortement modifi\u00e9 une motion de la Commission de l'\u00e9conomie (CER) du Conseil national, qui demandait une remise de loyer de 70%. Mais la CER du Conseil national a rejet\u00e9 ces modifications et a maintenant pr\u00e9sent\u00e9 une nouvelle motion.<\/p>\n<p>Le Conseil f\u00e9d\u00e9ral rejette la nouvelle motion tout comme les pr\u00e9c\u00e9dentes. Les questions complexes du droit du bail ne peuvent pas \u00eatre r\u00e9solues de mani\u00e8re globale par des adaptations temporaires de la loi, \u00e9crit le Conseil f\u00e9d\u00e9ral dans une prise de position. L'association Immobilier Suisse (VIS) se prononce \u00e9galement contre la proposition de compromis : Les contrats de location rel\u00e8vent du droit priv\u00e9, les solutions doivent \u00eatre trouv\u00e9es individuellement. C'est d'ailleurs d\u00e9j\u00e0 le cas pour deux tiers des baux concern\u00e9s, indique l'association, qui a men\u00e9 une enqu\u00eate aupr\u00e8s de 30 entreprises immobili\u00e8res. <em>(ah)<\/em><\/p>","protected":false},"excerpt":{"rendered":"<p>Apr\u00e8s des mois de conflit sur les loyers des commerces qui ont d\u00fb fermer suite au lockdown, un compromis se dessine.
